Poland: New Work Permit Procedure

Recently, the Polish Labor Office introduced a new legislation that modified the work permit application procedures.

This new legislation eliminated the requirement of 'obtaining Promise of Work Permit, based on issued visa.' Now, the Work Permit can be obtained and will be completed at the home country when the foreign national applies for a visa in order to legalize the stay in Poland. Please note however, that a Work Visa or Residence Permit must be obtained first to validate a Work Permit.

The whole procedure is approximately completed within 60 days from the date the complete application packet is submitted.

The Work Permit Validity is now seen to last for maximum of three years. However, authorities advised that in 2009, the permits will only be for 12 months. This is most likely a strategy to transition for the longer validity of the Work Permit.

Intra Company Transfer (ICT) has been simplified by eliminating 'workforce demand step'. The process is shortened for a month after eliminating that particular step.

The following must be met in exchange to the local market information.
a. Foreign national must remain on the payroll of the home country outside Poland
b. There is no employment contract with host entity based in Poland
c. The transfer is done within the same capital group


Observations:
The above procedure will help both the sponsoring company and the visa recipient in regards to timing and simplification of both application process. The ICT is very supportive to the business goals of both the home country company and host country company plus convenience of the employee. The key to success is that all entities involved must be synchronized and compliant to the regulations. Guidance from an experienced professional is essential if you are not certain on the components of the regulations.

Switzerland Now a Schengen Country Member

As of December 12th 2008 - Switzerland is the latest European Country that joined the Schengen Member Area. There are now 25 members consisting the Schengen Countries.

The following are the current members to the Schengen Countries;
Austria, Belgium, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Slovak Republic, Slovenia, Spain, Sweden, and Switzerland. These countries are also a part of the European Union Member States.

Bulgaria, Cyprus, Republic of Ireland, Romania and United Kingdom are Members of the European Union, however they are not a Schengen Member at this time.

While Switzerland is now a Schengen Member, the Swiss airports border control will remail in place until March 29, 2009 where its Schengen operation will begin.

There are several changes to visa requirements as an impact to the Schengen Membership of Switzerland.
1. The nationals of the following countries NOW require a visa when entering Switzerland;
  • Dominica
  • Fiji
  • Grenada
  • Jamaica
  • Solomon Islands
  • Suriname
  • Trinidad
  • Tobago and
  • Tuvalu
2. Nationals of the following countries will remain visa exempt when entering Switzerland; however this is only applicable when entering Switzerland and not entering other Schengen Member Countries where visa is required;
  • Antigua
  • Barbuda
  • Bahamas
  • Barbados and
  • St. Kitts-Nevis
3. Nationals holding an in-transit visa within Switzerland are no longer able to leave the transit area

4. Third country visa required nationals being alien residents of Andora, Canada, San Marino, USA, Bulgaria, Cyprus, Republic of Ireland and United Kingdom now require a visa

There are 5 types of Schengen Visa:
  • Type A - airport transit visa
  • Type B - transit visa
  • Type C - short period visa
  • Type D - long period national visa
  • Type D+C - visa that allows the holder to enter and stay for long term stay at the issuing Schengen state and can travel to other Schengen countries
Observations: Traveler must get guidance from an experienced professional consultant on Schengen countries when planning to visit or do business within the Schengen member countries. There are advantages and limitations on each visa types.

USA: US Lawful Permanent Residents Included in the US-VISIT Procedures Expansion

The Department of Homeland Security published a Final Rule that expanded the categories of all non-US citizens will be required to participate in biometrics collection - digital fingerprints and a photograph upon entry to the United States throught US-VISIT (United States Visitor and Immigrant Status Indicator Technology) Program.

Effective January 18, 2009 - all of the following non-US citizens will be required to provide biometrics when entering or re-entering the United States:
  • Lawful Permanent Residents of United States (a. at land border port, if they are referred to secondary inspection under the discretion of the inspecting officer, b. at seaports, when returning to US from an 'open' cruise
  • Persons entering US who seek admission on immigrant visas;
  • Persons entering the US who seek admission as refufees and asylees;
  • Canadian citizens who are currently required to obtain a Form I-94 (Arrival Departure Record) upon entry or who required a waiver of inadmissibility to the United States; including applicants for nonimmigrant classifications such as C, D, F, H, I, J, L, M, O, P, Q1, Q3, R, S, T, TN and others who are referred to a secondary inspection;
  • Persons paroled into the US
  • Persons applying for admission under the Guam VWP
  • H1B Visa holders when applying for a new multiple entry Form I-94 or when referred to secondary inspection for other reasons
  • Non-US citizens who seek admission with Border Crossing Cards and who do not have a Form I-94, at the discretion of the CBP Officers

USA: Continuing Updates: US Employment Eligibility - I-9 Form

The USCIS released an announcement in January 30 2009 about its 60 days period up to April 3rd 2009 - the implementation of the an interim final rule "Documents Acceptable for Employment Eligibility Verfication" which was published in the Federal Register on December 17th 2008.

The public will have more ample time to provide comments at the Federal Register. This public comment will end on March 4th 2009. Interested parties who would like to share their opiniions or comments can visit this website: http://www.regulations.gov/

The interim final rule will provide an amendment of the regulations governing the types of acceptable identity and employment authorization documents which employees can present to their employers when completing the I-9 Form (Employment Eligibility Form). Under the interim rule it prohibits the acceptance of an expired document to verify an employment authorization.

Observations:
As an employer's representative - the HR Professional who will be conducting the validation of acceptable identification documents for the I-9 Form must take an extra moment and effort in understanding appropriate documents that are acceptable.

As necessary, attend continuing education that are focused on Managing I-9 Eligibility Documents and Compliance. Seek the assistance of a qualified and experienced HR Consultant on Employment Eligibility and Work Permits.

There is a high risk for both the employer and the HR Professional when a new hire will be found to be using a non-acceptable document.

USA: TN Visas for Nationals of Canada and Mexico

Recently, the USCIS (United States Citizens and Immigration Services) announced the expansion of the Trade NAFTA (TN) Nonimmigrant Visa Program for professional workers from Canada and Mexico.

The annual extension of a TN Visa by a professional worker from Canada and Mexico has been changed to an increment of every 3 years. This expansion of the program will now be the same as the H1B Nonimmigrant Visa professional worker.

What This Means to TN Visa Holders? There are Five Highlights.

First, Any professional worker from either Canada and Mexico can now request for an extension of their TN Visa with an increment of three years instead of the usual annual extension.

Second, Workers must be advised to request for their three years extension when it is time to renew their TN Nonimmigrant Visa.

Third, Workers will now enjoy a once in every three years interruption from their job in regards to renewing their TN Visa.

Fourth, They can fully concentrate on their job function within three consecutive three years without getting bothered with their visa expiration date and renewals, thereby supporting the business goals and objectives of their employer.

Fifth, Increased productivity and Return On Investment.

What this means to an Employer? There are Four Highlights.

First, Each employer that sponsors TN Nonimmigrant Visa for professional worker from Canada or Mexico can experience a longer ease of visa renewals for their workers. This will advocate a better strategic approach, timing and calendaring of the TN Visa compliance which will expire every three years instead of every year.

Second, This facilitates higher retention and productivity of the TN Visa Holders, who are member of the workforce.

Third, This provides two years of savings of the usual Immigration Counsel's Fees and TN Application Fee, in addition to the Return on Investments from hiring the workers.

USA: HR Managers on Child Labor Violations in Iowa

It is sad to learn of the circumstances that took place in one of Iowa’s manufacturing firms. Particularly, when you read the reason why an HR Manager is facing charges. Based on the facts provided by the Society of Human Resources Management on the real circumstances of this case, it suggests none compliance of rules and regulations on the part of the involved HR Managers. Three important things that were truly significant violations were: (1) By allowing an under 18 years of age to work long hours before 7AM and after 7PM plus over time. This is an absolute negligence by the HR Manager by allowing these young adults to work provided they were aware of their real age. (2) Work Safety is one of them notwithstanding with the cause of the raid by the ICE – where (3) they found undocumented immigrants working in the workplace.

SHRM’s HR Week dated Sept 15, 2008 illustrated the article about the above case. I was terribly surprised about it. I cannot believe what happened … nothing I could do about it except continue reading the whole article. A part of the Article is being quoted below;

“The charges filed by the Iowa Attorney General on Sept. 9, 2008, allege that the underage workers handled dangerous equipment, such as circular saws and meat grinders, and that they were exposed to noxious chemicals. According to the attorney general’s affidavit, the company records show instances of children under the age of 16 working before 7 a.m. and after 7 p.m. while school was in session.”

“The records of Agriprocessors Inc. also confirm, as alleged by each of the employee-victims, that each of these employees worked more hours of overtime each week than that for which they were compensated,” the complaint stated.”

Observations

Having been an HR Practitioner, one of the items that I always coach managers when they hire is the guidance under the Labor Laws. Orienting them with the regulations on limitations involving the employment of minors during Summer Time and or during Internships is very important. These are basic responsibilities of an HR Professional to enforce the rules under the Law. For any environment where manufacturing exist, Work Safety is number one requirement to be enforced. Employment eligibility is always very important.

Reading through the article, you will realize that there were some facts that were not provided. Making you as the reader to formulate your own hypothetical assumptions on how situations were managed.

The article however, provides a very strong lesson for any Human Resource Professional in the profession. It is time to be strategic, pro-active and learn more about other rules, regulations and laws that may apply in your work environment. If you don’t have time for it – at least hire an experienced HR Consultant who can assist you with the compliance and enforcement of these rules. Act as an HR Business Partner to your colleagues in the operations departments and other business units. Negotiate your value as their HR Business Partner. Your extra efforts will save your company’s investments and avoid costly mistakes like the above.

Global: International Updates: What's Happening?

Australia: International Trade
Recently, the Australian Business International Trade Services outlined several items to be considered when setting up a business in China.

Ms. Sara Cheng, Manager for Greater China, Australian Business International Trade Services identified that "Business set-up in China is a big project by itself, which requires financial and time commitments, business management knowledge and China expertise. Identifying a competent agent to manage the complex process will be a cost and time effective way to avoid potential pitfalls." Details about the Article is available at this link.

Brazil: Experiencing Economic Growth
More and more international companies are opening their operations in the many cities of Brazil. This means that young professionals who would have planned to go abroad and search their international employment opportunities are staying in country.


There were indications as well that Brazilans who were living abroad are now returning to Brazil as there are employment opportunities that require their professional experience and qualifications.


Canada: Relaxed Visas and Opportunities for Permanent Residency
Recently, Diane Finley, Immigration Minister of Canada announced that "International students and skilled workers would be more likely to choose Canada if they knew their time and contribution to Canadian Society would assist in their eligibility to apply to stay permanently".

The Canadian government is in progress of establishing a programme that will facilitate the permanent residency of international skilled workers and students. It is hoped that this programme will come into effect in October.

Requirements for candidacy are: Professional experience, past education, English and or French Speaking Proficiency.


Strategic Observation: This initiative will surely increase human capital assets of Canada and will contribute to economic sustainability of the country.


China: Post Olympic
The logistical operations in Beijing are now returning to normal after the completion of the Olympics that was hosted by Beijing in the past weeks. However, the guidelines that were implemented prior to the Olympics are still in forced up to September 20th 2008.


Any inbound and outbound shipment in Beijing are still in strict and mandatory customs inspections. Deliveries of shipments are using shuttles and shuttle fees apply. These restrictions to operate trucks in the areas identified have caused backlog in Tianjin which most likely increased demurrage fees. It was initially announced that everything will resume normal after September 20th 2008.


Strategic Observations: If you have shipments that are anticipated to arrive or being delivered sooner than September 20th - don't panic as they will reach your destination a little longer that the normal calendar days. Most likely it will get delivered after Sept 20th or so.


Georgia: Cargo Delays and Travels
As an effect of the recent attacks in Georgia, there is a big disruption of cargo shipments deliveries. The international airport in Tbilisi has been temporarily avoided by international airlines. Officials are hopeful that it will only last for a week.

Jebel Ali, UAE - Delays Caused by Traffic
The Post in Jebel Ali in UAE is currently experiencing great delays of loading and offloading cargos due near full capacity operation. The delays affected ships from Asia and Europe that were meant to offload in Dubai Port. This port is the gateway access to the internal routes of the country such as air and sea transportation network.


Larger ships that can carry 8,000 containers at a time has to wait 24 to 30 hours in the queue in order to offload. Smaller ships has a longer waiting time as much as 90 hours.

Strategic Observations: You might consider the time element as an impact to the above consequences when shipping to any location that will pass through Dubai Port.

 
Kazakhstan: Foreign Citizens Registration
It is important that foreign citizens arriving in this country must register with the Police or with a License Hotel within 5 calendar days of arrival.


Foreign labor market and economic quota requirements will become available in December 2008.


Suggestions: Before you travel to Kasakhtan you will need to verify whether your hotel is Licensed for Registration of Foreign Citizens. In that way, you will strategically plan your time ahead.

Philippines: Angara at the Forum by Global Leadership for Climate Action
In Denver, Colorado, USA – Sen. Edgardo J. Angara told a forum here that fresh initiatives to combat climate change should likewise deal with the food shortages and poverty in developing countries, two grave problems in the developing world that are aggravated by extreme climatic shifts.

Angara made the call at a forum jointly hosted by the Club de Madrid, which is chaired by former US President Bill Clinton, and the Global Leadership for Climate Action, a United Nations Foundation founded by CNN founder Ted Turner. Angara was the only Filipino leader in that forum.


Angara said; "that violent typhoons and record-breaking monsoon rains have crippled rice and corn production in Southeast Asia. Extreme weather events have also turned rice production deltas in the region into watery graveyards for those killed by savage flooding."

Seoul, S. Korea: Expatriates Enjoy New Initiatives

The Expatriates living in Seoul, S. Korea will enjoy the new initiatives around Seoul when the city launched an online English reservation system on August 1 2008.

According to JoongAngDaily; "The city has operated the Internet reservation system since March 2005, but there was no English service.According to Seoul officials, expatriates will only need to enter their name and alien registration number to make a reservation. The Web site is http://yeyak.seoul.go.kr/index_Eyeyak.html Payment can be made with a credit card online.

Under the new system, expatriates will be able to reserve 249 city-operated facilities such as the Jamsil baseball stadium in Songpa District, Mokdong Ice Rink in Yangcheon District, Jangchung Gymnasium in Jung District and Seoul World Cup Stadium in Mapo District. Tennis, basketball and badminton courts at all 12 Han River parks are also available."


“As the world becomes more global, we need to offer handy services to expatriates living in Korea,” said Seoul official Na Jeong-pa. Online English reservations for classes offered by the Seoul city government will be launched soon, he said. Evaluate damaged aircraft structure, parts, and provide solutions beyond the applicable manual limitation in accordance with the FAA and OEM requirements. Develop engineering procedures, standards, and process specification to comply with vendors / manufacturer S/B, Airworthiness Directives, and other FAA requirements. Coordinate engineering functions with regulatory agencies as required for approval for major repairs and alterations including the completion and forwarding of documents to support such approvals. Provide technical assistance to various departments in support of the day to day operation and provide troubleshooting support. Other assignments as directed by the Manager of Engineering.



Required Qualifications:

1. BS in Aerospace or Mechanical Engineering degree with emphasis in aircraft structures
2. Five years of aircraft structural engineering experience with emphasis on Embraer in the airline industry
3. Competent in developing modifications and repairs to primary and secondary aircraft structures. Experienced in line and heavy maintenance onsite support
4. Five years of strong diversified experience on transport category aircraft, understand maintenance manuals, maintenance programs, and reliability programs
5. Demonstrate excellent verbal and writing skills with strong analytical abilities. Competent to communicate technical issues in an assertive way and tactful manner. Excellent command of both verbal and written English. French, Portuguese and Spanish verbal language proficiencies are a plus
6. Demonstrable project management competencies. Experienced in planning, implementation and administration of engineering programs and projects. Multi-task competencies in managing and coordinating tasks and projects simultaneously

USA - IRS Warning To Taxpayers About IRS Scammers

Today, the US Internal Revenue Service warned all Taxpayers in regards to IRS Scammers.

"Taxpayers to be on the lookout for a new wave of scams using the IRS name in identity theft e-mails, or phishing, that have circulated during the last two months. In May and June alone, taxpayers reported almost 700 separate phishing incidents to the IRS. In 2008 so far, taxpayers have reported about 1,600 phishing incidents to the IRS."

“Taxpayers should take steps to keep their personal information out of the hands of identity thieves,” said IRS Commissioner Doug Shulman. “That includes not falling for any of the phony e-mails or faxes now in circulation pretending to come from the IRS.”



How will this affect you? It is a matter of being vigilant and cautious on what information you are conforming to. You do not need to volunteer your personal information to anyone whom you do not know and aware of the transactions that is happening. Implement a validation process before you answer and provide anything.



Suggestion: Request the caller's name, company and telephone number as you will need to return the call as you are in the middle of something. Once you got the information, call back the number and speak with the person whose name was provided. You will be able to validate the caller's info and number whether it is real or not. Of course, you will need to do your best judgement and do your diligence.

US IRS Announced An Increased Mileage Rate Effective July 1, 2008 (IR-2008-82, June 23, 2008)

The US IRS (Internal Revenue Service) announced on June 22, 2008 an increase in the optional standard mileage rates for the final six months of 2008. Taxpayers may use the optional standard rates to calculate the deductible costs of operating an automobile for business, charitable, medical or moving purposes.

The above announcement is in support to taxpayers on the increased fuel costs, automobile costs for business and other purposes, including moving. Beginning July 1, 2008 through December 31, 2008, the new rates will be 58.5 cents per mile for business use, up from 50.5 cents, and 27 cents per mile for moving expenses, up from 19 cents.

This is an increase of eight (8) cents from the 50.5 cent rate in effect for the first six months of 2008, as set forth in Rev. Proc. 2007-70 The IRS usually adjusts the mileage rates once per year, but opted to do so this mid-year because the costs of fuel have increased dramatically in recent months.
